摘　　要：党的十八大以来,我国逐步形成了以《中华人民共和国科学技术进步法》为核心,以科学研究、知识产权、科技经贸法律法规等为配套的科技法学体系。文章从党的十八大以来的科技立法实践出发,总结了新时代我国科技法学建设的主要成就与科技立法的重点领域,在此基础上结合我国科技立法发展存在的主要问题,从法律体系规范、科学规律认知、开放视野3个方面入手,对我国科技法学的完善进行了探讨。当前,我国科技水平进入跟跑、并跑、领跑并存的新阶段,科技法学需要处理好法律规范与科学规律之间的关系,以科学学理论为基础重构自身规范体系,从而提升科技法学在经济、社会发展方面的前瞻性,为科技强国奠定法理基础。Since the 18th National Congress of the Communist Party of China,China has gradually formed The Science and Technology Progress Law of The People's Republic of China as the core and scientific research,a scientific and technology law system supporting scientific research,intellectual property rights,laws and regulations on science and technology economy and trade.Starting from the practice of science and technology legislation since the 18th National Congress of the Communist Party of China,the article summarizes the main achievements of China's science and technology law construction in the new era and the key areas of science and technology legislation,on this basis,combining with the main problems existing in the development of science and technology legislation in China,and discusses the improvement of China's science and technology law from three aspects of legal system norms and scientific law cognition and open vision.At present,China's science and technology level has entered a new stage of following and running,and running and leading coexist,law of science and technology needs to deal with the relationship between legal norms and scientific laws well,and reconstruct its own standard system on the basis of scientific theory,so as to enhance the forward-looking nature of science and technology law in economic and social development,and lay a legal foundation for a strong country in science and technology.
