摘 要:明本立教以孝治天下是儒家对实现理想大同社会的政治追求,善为政者,未有不以孝道治国。“孝”是沟通礼与法的桥梁,孝道与礼法也被历代王朝奉为国家治理的“至德要道”。北魏在融入汉文化过程中,积极践行着“孝”对国家礼制、法制建设的指引,“隆礼重法”的治国方针也使得北魏迅速立足中原并取得了较为广泛的民族认同。孝文帝改制作为北魏礼法融合历史进程中的关键一环,重视礼制对国家发展、观念更化、移风易俗中的重要使命,也强调援情断罪、撷精用宏、启承新创的法律儒家化。礼法的深度融合助力孝观念在北魏社会的传播,发挥着弘扬孝义的作用,推动形成基层治理与国家治理的良性互动。To rule the world with filial piety is the political pursuit of Confucianism to achieve the ideal universal peace.Filial piety is the bridge between ritual and law,and filial piety and ritual and law have been regarded as the “most virtuous way” of state governance by successive dynasties.In the process of integrating into Han culture,the Northern Wei dynasty actively practiced the guidance of filial piety in the construction of the state’s ritual and legal system,and the policy of “emphasizing rite and law” made the Northern Wei dynasty quickly gain a foothold in the Central Plains and achieve a wider national identity.As the most important part of the historical process of the fusion of ritual and law in the Northern Wei,Emperor Xiaowen’s reformation emphasized the mission of the ritual system for the development of the state,the change of concepts and the change of customs.It also attached great importance to the innovation on legal system which had introduced the aspiration of Confucianism into law construction ensuring that the judgement is more people-oriented.The deep integration of rituals and laws helps to spread the concept of filial piety in civil society,plays a role in promoting filial piety,and promotes the formation of a positive interaction between grassroots governance and national governance.
