数据法学对传统法学的挑战与应对--以山东大学“数据法学”建设为例

摘　　要：信息革命对既有的法律制度与传统法学带来重大冲击,如何建设数据法学以应对挑战,成为摆在国内外高等法学教育面前的共同难题.数据法学在理论、方法与价值层面全面超越传统法学,可谓法学研究范式的重大革命.山东大学法学院通过设立新型研究机构、创建新文科实验室、完善科研运行机制以及打造多元学术活动等方式革新组织形式,为数据法学研究的开展探索出全新的组织模式.在数据法学人才培养方面,法学院积极调整专业学位设置,扩大多学科背景生源,开设“法学+X”交叉课程,配备复合型师资,摸索新型教学方式,拓展丰富多彩的课外学术与社会实践活动,努力培养数字法治建设的栋梁之材.The information revolution has exerted a major impact on the existing legal system and traditional jurisprudence.How to develop a data jurisprudence as a response has become a common challenge facing law schools at home and abroad.Data jurisprudence,comprehensively surpassing traditional jurisprudence in terms of theory,methodology and value,can be regarded as a major evolution in the paradigm of jurisprudence research.The School of Law,Shandong University has explored a new organizational model for data jurisprudence research through establishing new research institutions,building the laboratory for new humanities and social sciences,optimizing research operation mechanisms,and organizing diversified academic activities.In terms of cultivating talents in data jurisprudence,the School has adjusted the professional degree setting,expanded the source of students with multidisciplinary backgrounds,and set up“law+X”interdisciplinary courses.Besides,the program is equipped with interdisciplinary teachers,experiments with new teaching modes,explores diversified extracurricular academic and social practices,striving to cultivate the pillars for digital rule of law construction.
