我国国防军事立法的历史成就和发展前瞻  

The Historical Achievements and Prospects of China’s National Defense and Military Legislation

摘　　要：国防军事法律是中国特色社会主义法律体系的重要组成部分。加强国防军事立法对于完善我国法律体系、保障实现强军目标具有重大意义。我国国防军事立法经历了萌芽探索、初创奠基、曲折发展、恢复发展、全面发展、新时代新发展等六个阶段发展历程,各个阶段都取得很大进步和成就。我国国防军事立法工作的丰富实践和成功经验启示我们,当前我国国防军事立法应当确立坚持党的领导、坚持合宪、坚持民主立法和坚持聚焦强军目标等四原则。未来我国国防军事立法应当全面贯彻习近平法治思想和习近平强军思想,加强重点领域立法,推进国防军事法律法典化、研究国防军事法律作为单独法律门类和改进军事法规备案审查制度。The national defense and military law is an important part of the socialist legal system with Chinese characteristics.It is of great significance to strengthen national defense and military legislation for improving the legal system and ensuring the realization of the goal of building a powerful military.China’s national defense and military legislation has gone through six stages of development which include embryonic exploration,initial foundation,tortuous development,recovery development,all-round development,and new-era development with their respective progress and achievements.The rich practice and successful experience of the national defense and military legislation have inspired us that our current national defense and military legislation should follow four principles of adhering to the leadership of the Party,the Constitution,democratic legislation,and the goal of building a powerful military.In the future,China’s national defense and Military legislation should fully implement Xi Jinping Thought on the Rule of Law and Xi Jinping Thought on Strengthening the Military,focus on strengthening legislation in key areas,and actively study to promote the codification and classification of national defense and military laws and improve the system of filing and reviewing military regulations.
