摘　　要：中医药文化遗产是数千年来中华民族积累的宝贵资源,有其自身的特点,而中国知识产权的产生和发展借助了西方几百年来知识产权制度的经验,如果将中医药文化遗产纳入现行知识产权保护体系,必将产生冲突,因此有必要研究中医药文化遗产的特点,建立符合中医药文化遗产特点的知识产权保护制度。Traditional Chinese medicine cultural heritage is a precious resource accumulated by the Chinese nation for thousands of years.It has its own characteristics.The generation and development of Chinese intellectual property relies on the experience of the Western intellectual property system for hundreds of years.If the traditional Chinese medicine cultural heritage is included in the current intellectual property protection system,there will be conflicts.Therefore,it is necessary to study the characteristics of traditional Chinese medicine cultural heritage and establish a system in line with the intellectual property protection system of the characteristics of traditional Chinese medicine cultural heritage.
