社区矫正法治化的逻辑预设

摘　　要：依法治国是我国的基本方略,社区矫正作为刑事执行制度的重要组成部分,也必然走向法治化。《社区矫正法》和相关的社区矫正的法律规定是社区矫正的行为规则。社区矫正法治化的前提是树立法治理念,关键是规制权力边界,核心是社区矫正制度创新,根基是社会力量广泛参与和规范化。社区矫正法治化不仅是贯彻《社区矫正法》立法精神的要求,也是社区矫正治理体系和治理能力现代化必由之路。The rule of law is the basic strategy of China,as an important part of the criminal execution system,community correction is bound to be ruled by law.The Community Correction Law of the People's Republic of China and the related legal provisions of community correction are the behavioral rules of community correc⁃tion.The premise of the rule of law of community correction is to establish the concept of rule of law,the key is to regulate the boundary of power,the core is the innovation of community correction system,and the founda⁃tion is the wide participation and standardization of social forces.The legalization of community correction is not only the requirement of implementing the legislative spirit of the Community Correction Law of the Peo⁃ple's Republic of China,but also the only way to modernize the governance system and capability of communi⁃ty correction.
