两岸融合发展法治建设的实践逻辑与推进路径

摘　　要：两岸融合发展蕴含的治理意蕴与法治期许决定了两岸融合发展法治建设的缘起与动变,并指向实践理性的维度。本文拟从理论、历史与现实的三重逻辑维度把握其科学内涵与精神实质,解析两岸融合发展及其法治建设之间的实践逻辑承继、脉络与发展,阐析着力完善两岸融合发展法治建设理论和制度体系,践行积极司法理念,提供智慧精准司法服务,赓续传统法治文化,进而促进趋同发展等四个向度推进两岸融合发展法治建设,以期通过融合创新规范来弥合两岸法律多元价值之间的裂隙,并保障法律条文切实转化为现实运作的法律秩序与实践法度,探索让法治的光辉照耀两岸融合发展,促其擢升,彰显两岸融合发展及其法治建设的现实关切获得众望所归的理由与拓展实践的进路,推进新时代两岸融合发展、国家统一事业。The governance implication and the expectation of the rule of law embedded in cross-Strait integrating development determine the origin and dynamic changes of the construction of the rule of law during the cross-Strait integrating development,and suggest a dimension of practical rationality.This paper intends to explore the scientific connotation and essence of the rule of law from three logical dimensions of theory,history and reality,and it aims to analyze the practical and logic continuation,evolution and progress between cross-Strait integrating development and the construction of the rule of law;this paper attempts to explicate and improve the legal and institutional systems in the construction of the rule of law during cross-Strait integrating development from four dimensions,i.e.,implementing the idea of positive justice,providing sensible and precise judicial services,passing down the traditional culture of the rule of law,and promoting convergence as well as progress.In doing so,this paper hopes to bridge the gap between multiple values concerning the laws on both sides of the Strait through integrating and innovating norms,to ensure the effective transformation of legal provisions to the legal order and principles of practice observed in reality;it strives to enable the rule of law to contribute to the cross-Strait integrating development,to illustrate the reasons for cross-Strait integrating development and how constructing the rule of law suits the practical concerns of the public,and to promote cross-Strait integrating development and national reunification in the new era.
