耕地生态补偿制度与“生态人”的耦合性分析

摘　　要：耕地生态补偿是实现耕地生态价值、经济价值以及社会价值和谐统一的有效手段。现阶段,我国耕地生态补偿理论研究滞后、立法保障不全等问题严重阻碍了耕地生态补偿制度的法治化进程。“生态人”理论与耕地生态补偿制度在主体要素、客体要素、目的要素以及实现路径上存在高度的耦合性,可以在多个领域和环节回应耕地生态补偿制度的法治化诉求,具体包括明确补偿主体与受偿主体,突显“生态人”的系统性;细化补偿标准和补偿方式,兼顾“生态人”的多重价值;健全区际耕地生态补偿,彰显“生态人”的公平正义;完善补偿监管保障机制,实现“生态人”的法治化。Cultivated land ecological compensation is an efficient solution to realize ecological value,economic value and social value. At present, the backward research of farmland ecological compensation theory and the incomplete legislative guarantee seriously hinder the legalization process of farmland ecological compensation system in China. "Ecological man" on the cultivated land ecological compensation system and theory of the subject, object, objective elements as well as the realization path there is a high degree of coupling, can be in multiple areas and link to respond to the cultivated land under the rule of law demands of ecological compensation system, including compensation and the compensation subject, have highlighted the systemic of "ecological man";Refine the compensation standard and compensation method, take into account the multiple values of "ecological man";Improve the ecological compensation of regional arable land, highlight the fairness and justice of "ecological man";We will improve the compensation, supervision and guarantee mechanism, and realize the rule of law for "ecological man".
