派出所民警民事纠纷调解的立法问题研究

摘　　要：由于相关法律依据不明确,民事纠纷警情的处置成为了困扰派出所民警的一项工作。派出所民警调解民事纠纷有着其他调解方式所不具备的便捷性,也有着客观必要性和法理上的可行性,理应通过立法明确赋予派出所民警民事纠纷调解职能。派出所民警调解民事纠纷的职能构建首要界定民警民事纠纷调解的范围和程序,并建立起调解工作的分流制度,让派出所民警民事纠纷调解工作具备现实可操作性。为使民警民事纠纷调解职能所承载的价值得到更好的实现,还应当建立诉调衔接和民警调解能力培养等配套性制度。Although civil disputes occur frequently,due to the unclear legal basis,the disposal of them has become a work perplexing the police in the police station.The police mediation of civil disputes in police stations not only has the convenience that other mediation methods do not have,but also has the objective necessity and legal feasibility.Therefore,the police should be clearly endowed with the function of civil dispute mediation by legislation.The?most?important?thing?is?to define the scope and procedures of civil dispute mediation,and establish a diversion system for mediation work,so that the civil dispute mediation work of police station police can be operable.In order to better realize the value carried by the civil dispute mediation function of the police,we should also establish supporting systems such as the connection system of litigation and mediation and the mechanism to improve the mediation ability of the police.
