基因技术专利化的伦理性研究——民法典1009条基因人格权维度

摘　　要：基因技术作为21世纪兴起的重点工程,在推动经济社会进步、促进科技发展方面具有重大意义,国家对此进行了相关政策的保护,在中共十九届五中全会上,习近平总书记提出要完善基因技术等新兴领域的知识产权保护制度,积极推动基因技术的发展。然而由于基因技术所涉内容复杂,尤其是近年来兴起的人体基因技术极易引起社会上的伦理争议,因此,在国家的宏观政策的指导下,使得基因技术符合伦理性要求是推动基因技术向善发展的重要举措。《中华人民共和国民法典》人格权编第1009条首次创立了人体基因的保护规范,由此催生了学界对基因人格权这一新型权利的探讨。在论证基因人格权这一新型权利的基础上,探究其背后的伦理价值并在此基础上反思基因技术的专利授予中应遵循的伦理规范,对于在专利授予中避免潜在的道德风险与伦理危机、维护社会的和谐秩序具有重要意义。As a key project in twenty-first Century, gene technology has great significance in promoting economic and social progress and promoting the development of science and technology. The state has carried out relevant policies to protect it. In the fifth Plenary Session of the 19 th CPC Central Committee, the CPC General Secretary Xi Jinping proposed that we should improve the intellectual property protection system of new formats such as genetic technology and actively promote the development of genetic technology. However, due to the complexity of the content of gene technology, especially the rise of human gene technology in recent years, it is easy to cause ethical disputes in society. Therefore, under the guidance of the national macro policy, making gene technology meet the ethical requirements is an important measure to promote the good development of gene technology. Article 1009 of personality right in the civil code of the People’s Republic of China establishes the protection standard of human gene for the first time, which gives birth to the academic discussion on the new right of gene personality right. On the basis of demonstrating the new right of gene personality, this paper explores the ethical value behind it, and reflects on the ethical norms that should be followed in the patent granting of gene technology, so as to avoid the potential moral hazard and ethical crisis in the patent granting and maintain the harmonious order of society.
