公安机关自由裁量权的内部控制及其路径

摘　　要：作为行政执法活动的重要主体之一,公安机关在社会治理体系构建中发挥着基础性作用。在学界,对于公安机关自由裁量权外部控制的讨论极其热烈,但内部控制鲜有问津。司法实践中,外部控制确实发挥了一定积极作用,但受困于主体之间的联系性、执法活动范围的相对性等因素,外部控制的隐性劣势亦逐渐凸显。在有限的外部控制作用下,内部控制体系具有同步性、专业性和主动性等显著优势,能够展现良好的监督质效。因此,由公安机关自由裁量权内部控制视角出发,结合我国实际优化公安机关裁量基准制度、警务公开制度、行政复议制度和行政案例指导制度,构建一套行之有效的内部控制复合模式既是当前实践所需,也是自由裁量权核心目标价值实现的基础要素。As one of the important subjects of administrative law enforcement,public security organs play a fundamental role in the construction of social governance system.In the academic circle,the discussion on the external control of the public security organs’ discretion is extremely heated,but the internal control is rarely concerned.In judicial practice,external control has indeed played a positive role,but due to such factors as the connection between subjects and the relativity of the scope of law enforcement activities,the hidden disadvantage of external control has gradually emerged.Under the limited external control,the internal control system has significant advantages such as synchronization,professionalism and initiative,which can show good quality and efficiency of supervision.Therefore,from the perspective of internal control of public security organs’ discretion,combining with China’s actual situation to optimize the benchmark system of public security organs’ discretion,the public policing system,the administrative review system and the administrative case guidance system,building an effective composite model of internal control is not only required by the current practice,but also the basic element to realize the core goal value of discretion.
