摘　　要：随着总体国家安全观、流域生态保护与高质量发展战略的提出和深入推进,流域生态安全在国家安全、区域发展和人类文明演进方面的重要地位已经获得普遍认同。但作为一项跨学科议题,不同学科关于流域生态安全的基本概念、基础理论认识仍存在明显分歧,造成了流域生态安全法律保障中的诸多矛盾和问题。法学视野下的流域生态安全强调的是流域法律关系和流域空间法律秩序,其法学内涵是指国家保障人类所处流域生态系统相对处于没有危险、不受威胁的状态并具备可持续发展的能力,由流域生态安全法律关系的复杂性、衍生性、跨域性特征及其客体属性所决定。实现流域生态安全法治保障目标,需要进一步完善流域立法体系、推动流域法律的生态化变革,以流域法治为载体推动法的生态安全价值客观化,以流域生态功能保护为核心建构流域生态安全法律制度体系。With the development of a holistic approach to national security,watershed ecological protection and high-quality development strategy,the importance of watershed ecological security in national security,regional development and the evolution of human civilization has been widely recognized. However,as an interdisciplinary issue,there are still obvious differences in the basic concepts and basic theoretical understanding of watershed ecological security among different disciplines,resulting in many contradictions and problems in the legal protection of watershed ecological security. The basin ecological security under the legal perspective emphasizes the legal relationship and the legal order of the basin space. Its legal connotation refers to that the state guarantees that the ecosystem of the basin where human beings live is relatively in a state of no danger and no threat and has the ability of sustainable development,which is determined by the complexity,derivation,transregional characteristics of the legal relationship of the basin ecological security and its object attributes. To achieve the goal of legal protection of watershed ecological security,it is necessary to further improve the legislative system of the watershed,promote the ecological reform of the watershed law,promote the objectification of the ecological security value of the law with the watershed rule of law as the carrier,and construct the legal system of watershed ecological security with the protection of watershed ecological functions as the core.
