整体性治理视域下的路长制实践困境与路径优化

摘　　要：公路作为公共产品,是国家交通运输的重要载体。相比于突飞猛进的交通建设,公路治理一直存在“重建轻管”的问题。公路治理涉及多个管理部门,若部门协调合作机制不健全,则可能导致治理的碎片化现象,进而出现多头执法、推诿扯皮等问题。路长制作为城市公路治理现代化的制度创新实践,在统筹协调各管理部门的基础上,克服了政府治理碎片化的问题,推动基层治理进一步走向系统化和精确化。但在具体实践中,路长制也面临着权责不清、合作机制缺失、激励制度设计不足等诸多挑战,实际治理中的碎片化现象依然严重。从整体性治理的视角出发,可以通过立法规范、制度约束、资金保障及多元治理等方式突破路长制的实践困境,进一步推进公路治理的制度创新。Roads,as the public products,are the important carriers of the national transportation.However,compared with the rapid traffic construction,there exists the problems of"highlighting construction while neglecting administration"in road management,which involves multiple administrative departments.If the coordination and cooperation mechanism between the departments is not well run,it will lead to fragmented management problems,such as multi-level law enforcement and prevarication.As an institutional innovation in the modernization of urban road management,the Road-inspector System has solved these problems and promoted grass-roots management to be more systematic and precise on the basis of overall planning and coordinating.However,in the specific practice,the Road-inspector System also faces many challenges such as unclear powers and responsibilities,insufficient cooperation and incentive policies etc.,which lead seriously to the fragmented management.From the perspective of holistic governance,the practical dilemma of the Road-inspector System can be broken through legislative norms,institutional constraints,capital guarantee and diversified governance,thus the institutional innovation of road management can be promoted.
