摘　　要：在《最高人民法院关于适用民法典侵权责任编若干问题的解释(草案)》是否规定债权侵权责任举棋不定之际,最高人民法院颁布了《涉执行司法赔偿解释》,其中规定了错误执行行为侵害债权的侵权损害赔偿责任的规范。这对于适用《民法典》规定的侵权责任规则保护债权,确认债权是《民法典》侵权责任保护范围、民事审判认定债权侵权责任、债权转移其侵害债权的损害赔偿请求权一并转移以及确定债权侵权损害赔偿责任范围等方面,都具有重要的借鉴价值,对推动债权侵权责任的法律适用具有重要意义。At a time when the Supreme People's Court was indecisive about whether to provide for tort liability for claims in the Interpretation of the Supreme People's Court on Several Issues of the Application of the Tort Liability Part of the Civil Code(Draft),the Supreme People's Court promulgated an interpretation of judicial compensation involving execution,which provides for the regulation of tort liability for damages for wrongful execution against claims.This has an important value for the application of the tort liability rules stipulated in the Civil Code to protect claims,confirming that claims are the scope of protection of the tort liability of the Civil Code,the civil trial to determine the tort liability of claims,the transfer of claims whose damages for infringement of claims are transferred together and the determination of the scope of tort liability of claims for damages,etc.,and is of great significance to promote the legal application of the tort liability of claims.
