摘　　要：人工智能技术是现代科技的产物,是新经济发展的驱动力。人工智能音乐已走过65年的发展历程,形成了诸多令人耳目一新的音乐作品,在演艺经营、唱片发行、影视配乐、背景音乐等领域中应用广泛,产生了可观的经济效应。然而,各国对于人工智能音乐的著作权问题还存在较大的争议,在立法层面上更是相对滞后,这不仅不利于著作权制度的完善,也对人工智能音乐产业的进一步发展形成了障碍。根据人工智能音乐生成的过程及其特征,将其置于汇编作品的角度进行分析,将对人工智能音乐的著作权保护提供新的视角。Artificial intelligence technology is the product of modern science and technology and the driving force of new economic development.Artificial intelligence music has gone through 65 years of development,and has formed many refreshing music works.It has been widely used in performance business,record distribution,film and television music,background music and other fields,and has produced considerable economic effects.However,there is still a big dispute about the copyright of artificial intelligence music in various countries,especially at the legislative level.This is not only bad for the improvement of the copyright system,but also an obstacle to the further development of the A1 music industry.Based on the process and characteristics of artificial intelligence music generation,this paper analyzes it from the perspective of compilation works,and will provide a new perspective on the copyright protection of artificial intelligence music.
