数字时代NFT著作权若干问题思考

摘　　要：通过分析NFT发展过程中出现的著作权争议,对NFT著作权侵权现象和责任认定进行了阐述,提出应建立法律中的NFT强保护体系、结合CC0协议实现著作权共享、赋予平台审核义务及建立用户自我监管机制、积极参与国际交流探寻国内保护方案的建议。今后应不断加强NFT著作权保护机制研究,探索助力数字经济发展和知识产权强国建设的新方案。By analyzing the copyright disputes in the development of NFT,this paper expounds the infringement of NFT copyright and the identification of liability,and puts forward suggestions on establishing a strong NFT protection system in the law,realizing copyright sharing in combination with the CC0 agreement,giving platform audit obligations,establishing a user self-regulation mechanism,and actively participating in international exchanges to explore domestic protection schemes.In the future,the research on NFT copyright protection mechanism should be continuously strengthened,and the new solutions to help the development of digital economy and the construction of a powerful intellectual property country should be further explored.
