干细胞再生医学运用的民法规制:意旨、解释与适用

摘　　要：干细胞技术的发展对《民法典》相关法律规范的解释适用产生一定影响。为符合规范意旨,应运用目的性限缩、目的性扩张以及漏洞填补等方法对法律规范进行解释适用。对《民法典》第1007条禁止交易的“人体细胞”应当限缩解释,将作为药物被批准上市的含有活性人体细胞的干细胞制剂予以排除;对《民法典》第1007条禁止交易的客体范围,应通过类推适用将法律规范对“人体胚胎”的遗漏进行填补;对《民法典》第1009条中的“医学”概念应当适度扩张,以便适应干细胞临床技术的发展。基于干细胞技术的多层次性,应区分干细胞再生医学运用的不同场景和法律规范保护的不同法益,运用法律解释方法和司法推理准确适用法律。The development of stem cell technology has a certain impact on the interpretation and application of relevant legal norms in the Civil Code.In order to comply with the legislative intent of legal norms,relevant concepts should be limited or expanded and fill in the blemishes.The interpretation of prohibition of the transaction of“human cells”that indicated in Article 1007 of the Civil Code should be limited.The stem cell preparations containing active human cells that have been approved for marketing as drugs should be excluded.For the scope of objects prohibited from trading in Article 1007 of the Civil Code,the omission of“human embryo”should be filled in legal norms by analogy;the concept of“medicine”in Article 1009 of the Civil Code should be appropriately expanded in order to adapt to the development of stem cell technology and clinical technology.Based on the multi-layered nature of stem cell technology,the determination of the validity of a contract involving stem cells should distinguish different legal interests such as legal norms to protect body rights,ethics and public interests,and choose the correct interpretation path,which cannot be generalized.
