私人规制视域下网络主播黑名单议题

摘　　要：在网络直播规制工具箱中,主播黑名单制度通过“行业自我规制”与“平台自我规制”,实现了公法规制任务由网信和文化监管机构向CAPA直播分会和市场化互联网直播平台的转移,具有“私人规制”的范式特征,在理论上具有降低监管成本、提振监管效能与减弱行政干预的制度优势。然而,在实践中,受限于行业协会的政策定位、互联网平台的监管模式等规制理论解释范畴之外的背景因素,主播黑名单工具虽然具有“私人规制”的外观构造,但其内在规制进路依循压力驱动机制。规制任务在“政府-CAPA直播分会-直播平台-主播”的运行路径下层层传导,带有明显的“自上而下”的压力驱动逻辑,并由此造成网络主播的权利救济困境。In the online live broadcast regulation toolbox,the anchor blacklist system has realized the transfer of public law regulation tasks from the online trust and cultural regulatory agencies to the CAPA live broadcast branch and the market-oriented Internet live broadcast platform through"industry self-regulation"and"platform self-regulation".It has the paradigm characteristics of"private regulation",and has the institutional advantages of reducing regulatory costs,improving regulatory effectiveness and weakening administrative intervention in theory.However,in practice,due to the background factors beyond the scope of regulatory theoretical interpretation,such as the policy orientation of industry associations and the regulatory model of Internet platforms,the anchor blacklist tool has the appearance of"private regulation",but its internal regulatory approach follows the pressure driven mechanism.The regulation task is conducted layer by layer under the operation path of"government CAPA live broadcast branch live broadcast platform host",with an obvious"top-down"pressure driven logic,and thus causes the right relief dilemma of network anchors.
