相对独立外部体育仲裁机构的中国建构分析——基于设立主体与设立方式的分析

摘　　要：我国体育仲裁机构设立类型可以归为四类:内部体育仲裁机构、相对独立内部体育仲裁机构、独立外部体育仲裁机构和相对独立外部体育仲裁机构。基于《中华人民共和国体育法》相关条款的分析,未来我国体育仲裁机构的模型应当是相对独立外部体育仲裁机构。相对独立外部体育仲裁机构在设立主体层面表征为设立主体与运行管理的二分结构,即体育行政部门主导体育仲裁机构的设立,体育组织负责体育仲裁机构的运行管理。这种二分结构是体育自治本土化的体现、是体育组织自主能动性的彰显、是具备中国特色的体育仲裁机构建构模式。在设立方式层面可以遵循“试验模式”,原因在于体育仲裁制度得以确定实属不易,通过“试验模式”获取实践经验以修正原有制度设计可能存在的偏差,进而完善体育仲裁制度。同时,“试验模式”彰显以人民为中心的思想,也符合决策者对体育仲裁机构建构过程的审慎要求。The sports arbitration institutions in China can be categorized into four types:internal sports arbitration institutions,relatively independent internal sports arbitration institutions,independent external sports arbitration institutions,and relatively independent external sports arbitration institutions.According to the Sports Law of the People's Republic of China,the future model of China's sports arbitration institutions should be relatively independent external sports arbitration institutions.The relatively independent external sports arbitration institution is manifested in the dichotomous structure of establishment and operation management at the level of the establishment body,that is,the sports administrative department leads the establishment of the sports arbitration institution while the sports organization responsible for the operation and management of the sports arbitration institution.This dichotomous structure is the embodiment of sports autonomy,the manifestation of the autonomy and dynamism of sports organizations,and the construction model of sports arbitration institutions with Chinese characteristics.The reason for following the“experimental model”in the establishment of the institution is that it is not easy to establish a sports arbitration system,and it is important to gain practical experience through the“experimental model”in order to correct possible deviations in the original design of the institution and to improve the sports arbitration system.At the same time,the“experimental model”demonstrates the people-centered ideology and meets the prudent requirements of policy makers for the process of constructing sports arbitration institutions.
