社会组织腐败内部治理的制度困局及其化解

摘　　要：现阶段我国的社会组织在一定范围存在腐败行为,其腐败治理水平急需提升。从共和理论来看,组织内分治结构与公共文化氛围是组织权力制衡制度发挥作用的两个基本前提。从结构与文化的双重视角建构一种制度分析框架,可以讨论社会组织腐败的内部治理问题。通过对调研材料的理论分析发现,草根社会组织权力制衡制度无法建立、法人型社会组织权力制衡制度不合理且执行不到位等规制性困局影响了社会组织腐败治理成效。针对规制性困局产生的原因,须从建立健全组织权力分治结构、完善组织权力制衡制度、营造组织公共文化氛围等方面着手,破解社会组织腐败治理的规制性困局,为提升其腐败治理水平提供支持。At present,non-profit organizations are still contaminated with public interest corruption in different scopes with varying degrees,and the level of corruption treatment is to be improved.From the perspective of republican theory,decentralization structure and public cultural atmosphere are two basic preconditions for the system of power balance to play its role.Thus,an institutional analysis framework can be constructed from the dual perspectives of structure and culture to discuss the internal treatment of non-profit organization corruption.Through the theoretical analysis of the research materials,it is found that the lack of the power balance system of grassroots non-profit organizations,the absence of the power balance system of corporate non-profit organizations coupled by weak executions and other regulatory deficiencies interfere with public welfare corruption treatment.Based on the causes of the regulatory dilemma,it is necessary to establish and perfect the structure of organizational power separations and the system of power balance and create an organizational public culture atmosphere so as to resolve the regulatory dilemma and provide strong support for improving the level of corruption treatment.
