摘　　要：负有照护职责人员性侵罪的增设加强了针对未成年女性的保护、完善了刑法体系、回应了社会关切。本罪的保护法益是已满14周岁、未满16周岁女性的性自主权,增设本罪的目的在于弥补传统强奸罪认定过程中的漏洞,实现“特定性犯罪去手段化”。本罪的认定应着眼于由不平等关系所产生的“心理强制”,但是不能简单将不平等关系与侵犯性自主权画等号。“发生性关系”需要具体考察未成年女性的真实意愿,行为方式不限于狭义的性交行为。行为人对未成年女性精神上的支配或影响是“双方实质上处于特殊关系”的核心要素。本罪与强奸罪属于对立关系,对于“情节恶劣”的判断应考虑奸淫行为所导致的身体损害。The addition of sexual assault by persons with care duties has strengthened the protection of underage females,improved the penal system,and responded to social concerns.The protection of this crime is the sexual autonomy of females who have reached the age of 14 and under the age of 16,and the purpose of adding this crime is to close the loopholes in the traditional crime of rape determination process and realize the"de-instrumentation of specific sexual crimes".The determination of this crime should focus on the"psychological coercion"resulting from unequal relations,but it cannot simply equate unequal relations with intrusive autonomy."Having sex"requires a specific examination of the true wishes of underage females,and the way of behavior is not limited to sexual intercourse in the narrow sense.The moral domination or influence of the actor over the underage females is the core element that"the parties are essentially in a special relationship".This crime is opposed to the crime of rape,and the judgment of"aggravating circumstances"should take into account the bodily damage caused by the adultery.
