民法典背景下中国法理学的二元发展

摘　　要：法理学与部门法学的关系问题是影响法理学发展的传统问题。构建以“法理”为中心的法理学发展体系虽已成为当代法理学发展的趋势,但要解决法理学与部门法学之间的关系纷争还需从根本上对法理学进行反思和批判。面对部门法学的功用期待和实践中的难题拷问,将法理学二元划分为理论法理学和工程法理学不失为一条可行路径。2020年颁布的民法典为法理学二元发展理论提供了新的分析对象。以民法典为研究对象对其进行法理梳理,从而透视法理学二元发展的逻辑路径,一方面挖掘了民法典从制定形式到价值内核的庞大法理资源,另一方面也为理论法理学和工程法理学在法治发展浪潮中指明了方向。因此,社会主义新时期的法理学学科建设要坚持二元发展路径,既要加强以“法理”为中心议题的理论法理学研究,又要重视法治实践问题引导下的工程法理学研究。The relationship between jurisprudence and departmental jurisprudence is a traditional problem that affects the development of "jurisprudence". It has become the goal of the development of jurisprudence to build a jurisprudence theory system centered on jurisprudence. It is necessary to rethink and criticize jurisprudence in order to solve the relationship disputes between jurisprudence and departmental jurisprudence. Facing the functional expectation of department jurisprudence and the problems in practice,it is a feasible way to divide jurisprudence into theoretical jurisprudence and engineering jurisprudence. The Civil Code promulgated in 2020 provides a new analysis object for the dual development theory of jurisprudence. Taking the Civil Code as the research object,this paper combs the legal theory,so as to see the logical path of the dual development of jurisprudence. On the one hand,it excavates the huge legal theory resources from the formulation form to the value core of the Civil Code;on the other hand,it also points out the direction of theoretical jurisprudence and engineering jurisprudence in the development of the rule of law. Therefore,the construction of jurisprudence in the new period of socialism should adhere to the dual development path,not only strengthening the theoretical jurisprudence research with "jurisprudence" as the central topic, but also attaching importance to the engineering jurisprudence research under the guidance of the rule of law practice.
