摘 要:茶亭作为传统中国的小型公共品,广泛分布于乡村社会,是民间社会自发形成的公益性供给。不同于政府和市场模式的民间自治,茶亭的非政府性、非营利性具有坚实的逻辑起点与历史渊源。其中,具备独立资产与理事会监管的茶亭更体现了传统中国公共品的法人产权特征。此种由民间自发形成的秩序既受到个体、民间组织、政府乃至全社会的共同支持和保障,与此同时又推动了民间管理的制度化演进。Tea kiosks,as small traditional public goods in China,are widely distributed in rural society.They are an autonomous non⁃profit supply by the civil society.Different from the civil autonomy of government and market model,the non⁃governmental and non⁃profit nature of tea kiosks has a solid logical starting point and historical origin.Among them,the tea kiosks with stand⁃alone assets and supervision from the board of directors are more reflective of the legal person property rights of traditional small public goods in China.This type of unprompted non⁃governmental order by the people is supported and guaranteed by private ownership,non⁃governmental organizations,the government and even the whole society.At the same time,it promotes the institutional evolution of non⁃governmental management.
