摘　　要：技术方案是纵向发展的,具有累积性特点,其保护模式不同于具有横向发展特点的文化成果。在专利制度中,相对于国务院专利行政部门的登记,技术方案的完成具有基础性作用。从职能上看,只有市场主体的生产性努力才会实现财富的增长,政府部门关于财产的程序性规定,追求的是秩序与公平。专利制度中的申请与商业秘密保护模式中的保密、合同法模式中的要约等,均反映了发明人的意思自治。申请具有自由和公开的双重性质,启动了专利保护。就技术方案的保护而言,专利制度与商业秘密保护模式、合同法模式存在内在关联性,应对三种保护模式给予体系化理解和解释。国务院专利行政部门的登记并不影响专利权的私权属性,专利登记在发挥公示作用的同时,具有财产管理的性质。The technical solutions are developed vertically and have the characteristics of accumulation.Its protection mode is different from that of the cultural achievements which have the characteristics of horizontal development.In the patent system,compared with the registration in the national patent administrative agency,the completion of technical solution itself has a fundamental role.In terms of their functions,only the productive efforts of market subjects can realize the growth of wealth,while what the procedural provisions on property for government agencies pursue are order and fairness.The application in the patent system,the confidentiality in the trade secret protection model,and the offer in the contract law model all reflect the autonomy of inventor’s will.The patent application which initiated patent protection has the dual nature of freedom and openness.As far as the protection of technical solutions is concerned,the patent system is intrinsically related to the mode of trade secret protection and that of contract law.Three modes of protection should be understood and explained systematically.The registration by the national patent administration agency does not affect the private right attribute of the patent.While playing the role of publicity,the patent registration has the nature of property management.
