摘 要:由于劳动关系的从属性,个人信息的一般保护规则难以适用于劳动领域,以个体为主要调整对象的现行法律无法为劳动群体的信息权益提供有效保护。而作为缓解劳资冲突与维护劳动者权益的专门组织,为劳动者个人信息等精神性人格权(益)提供有效保护是工会的应然职责。因此,借助工会的力量就个人信息处理与用人单位进行集体谈判,能够在一定程度上补足劳动者欠缺的维权积极性,缩小劳动者与用人单位谈判能力的差距。对此,有必要从工会集体保护的角度切入,通过加强劳动领域立法、增强工会集体协商能力以及提升民主程序参与度等路径,对劳动者个人信息进行保护。Due to the subordination of labor relations,the general protection rules of personal information are difficult to apply to the labor field,and the current laws with individuals as the main adjustment object cannot provide effective protection for the information rights and interests of labor groups.As a special organization to alleviate labor conflicts and safeguard workers rights and interests,it is the natural duty of trade unions to provide effective protection for workers personal information and other spiritual personality rights(interests).Therefore,collective negotiation with employers on personal information processing with the help of trade unions can,to a certain extent,make up for the lack of enthusiasm of workers for safeguarding their rights and narrow the gap in negotiation ability between workers and employers.In this regard,it is necessary to protect the personal information of workers from the perspective of collective protection of trade unions by strengthening legislation in the field of labor,enhancing the ability of collective negotiation of trade unions and enhancing the participation of democratic procedures.
