摘  要:基于当前裁判实践的分析,近年来高校人事争议呈现出诉讼案件数不断增加、诉讼对抗性不断增强、诉讼争议焦点集中、争议解决诉求多样化等新趋势、新特点。本应在处理高校人事争议中发挥重要作用的高校工会,却由于缺少专业人员、介入规则不明确、工会职能行政化、工作理念保守等因素的限制,处于被高校和教职工双方都忽略的境地。应积极探索建立高校工会统筹下的人事争议调解处理机制,推进落实法律援助工作发挥实效,规则化介入人事争议的程序,坚持在高校党委的领导下处理好与行政组织之间的关系,更新工作理念等路径,寻找破除困境之出路促进高校人事争议的调处解决,响应新时代高校工会构建高校和谐劳动关系的历史使命。Based on the analysis of current adjudication practice,the personnel disputes in colleges and universities in recent years present new trends and characteristics such as increasing number of litigation cases,increasing adversarial nature of litigation,concentrated focus of litigation disputes and diversification of dispute resolution demands.The labor unions,which should play an important role in handling personnel disputes in colleges and universities,are in a situation that is ignored by both universities and staffs due to the limitation of lack of professional personnel,unclear rules of intervention,administration of trade union functions and conservative working concept.The labor unions of colleges and universities should actively explore the paths of establishing a mechanism for mediation and treatment of personnel disputes under the coordination of the labor unions of colleges and universities,promoting the implementation of effective legal aid work,regularizing the procedures of intervention in personnel disputes,insisting on handling the relationship with administrative organizations under the leadership of the Party Committee of colleges and universities,and updating the working concept,so as to find a way out of the dilemma to promote the mediation and settlement of personnel disputes in colleges and universities,and respond to the historical mission of college labor unions to build harmonious labor relations in colleges and universities in the new era.
