摘　　要：养老服务合同是养老机构与老人或其代理人对双方权利义务的安排,但司法裁判就合同中格式条款的效力认定存在分歧。针对养老服务合同中不同类型的格式条款,法院的态度和裁判思路存在差异,反映出当前司法实践中存在的格式条款的效力审查范围模糊、法律适用混乱、裁判标准不清的问题。通过排除核心给付条款和给付描述条款,以界定养老服务合同中格式条款的效力审查范围。从一般法律行为和免责条款的效力判断规则出发,构建层层递进式的效力审查路径。从价值位阶、合同目的、给付均衡、风险的控制与分担的角度细化养老服务合同中格式条款的“合理性”审查标准,并对养老服务合同中格式条款的效力争议作以回应。Elderly service contract is an arrangement of the rights and obligations of the nursing home with the elderly or their agents.However,judicial judgments have different opinions on the validity of standard clauses in this contract.Regarding different types of standard clauses in elderly service contracts,the court’s attitudes and judgments are different.This phenomenon reflects current judicial problems,including vague scope of review,confusion in application of laws,and unclear judgment standards.By excluding core payment clauses and payment description clauses,the scope of validity review of standard clauses in elderly service contract is defined.With the help of legal norm of judging validity on the general legal actions and the exemptions,a progressive path of validity review is constructed.From the civil value rank,contract purpose,payment balance and risk-controlling,it refines the"reasonability"review standard of standard clauses in elderly service contracts.Finally,the paper responds to the dispute about the validity of standard clauses in elderly service contracts.
