摘　　要：目的了解医疗机构从业人员职务犯罪现状,并提出对策与建议。方法采用案例分析法分析中国裁判文书网相关文书,总结廉洁风险规律特点;采用工作-风险分解法,构建风险清单。结果医疗机构从业人员职务犯罪案件发生率较高,涉案金额高,涉案主体职务高、相对集中,判决罪名以受贿罪为主,部分案件数罪并罚,工作风险清单包括4大类27个环节易出现职务犯罪。结论当前医疗机构反腐倡廉形式复杂严峻,职务犯罪社会危害性大。医疗机构应完善廉洁风险防控体系建设,制定权力清单、责任清单和风险清单,强化对重点部门和重点岗位的监督管理,提升纪检监察队伍专业能力和综合能力水平,加强对权力的监督制约,创新多举措廉洁风险学习形式,重视警示教育,促进廉洁风险防控长效运行,推进医疗机构廉洁建设的健康发展。Objective To investigate the current situation of duty crimes of practitioners in medical institutions and propose countermeasures and suggestions.Methods The method of case study was done to analyze the verdicts from China Judgments Online and summarize the characteristics of integrity risks.The WBS-RBS method was used to establish a list of integrity risks.Results The incidence of duty crimes of medical institution practitioners was high,the amount involved in the crimes was high,the criminals involved were at higher ranks and relatively clustered.The majority of judged crimes were bribes,and some of them combined with other crimes.The list of integrity risks covered 4 categories with 27 links,where the practitioners were susceptible to such crimes.Conclusion Anti-corruption in medical institutions is complex and severe.Since duty crimes do great harm socially,it is imperative for medical institutions to completely establish an integrity risk prevention and control system,work out a power list,duty list and risk list,strengthen the supervision and management of key departments and key position and enhance the level of professional ability and comprehensive ability of discipline inspectors.On the other hand,they should strengthen the supervision over power,innovate learning models for integrity risks prevention and control and attach importance to warning education,so as to ensure long-term operation of the integrity risk prevention and control and ultimately promote the healthy development of integrity construction in medical institutions.
