论我国投资争端预防机制的不足及完善

摘　　要：争端预防与争端解决联系紧密,但是二者在目的、效果等方面区别明显。在经济全球化的背景下,国际投资争端频发。由于投资仲裁存在一定缺陷,各国对于国际投资争端的关注焦点逐渐侧重于事前预防。伴随“一带一路”倡议的提出,为了化解投资争端,优化我国投资软环境,构建和完善投资争端预防机制具有重要意义。我国近年来颁布相关投资法律构建投资争端预防机制,但该机制尚存在投资争端预防机构行政化特点突出、外商投资企业投诉工作机制不健全,以及双边投资协定中投资争端预防机制的规定待于完善等问题,需要在改革投资争端预防机制运行模式、健全外商投资企业投诉工作机制,以及改进双边投资协定内容等方面加以完善。While dispute prevention and dispute settlement are closely related,they are obviously different in their purpose and effect.In the context of economic globalization,international investment disputes occur frequently.Due to certain defects in investment arbitration,countries have gradually focused on the prior settlement of international investment disputes.With the proposal of the "the Belt and Road" Initiative,it is of great significance to build and improve the investment dispute prevention mechanism in order to resolve investment disputes,and optimize China’s investment soft environment.In recent years,China has promulgated a number of investment laws to build an investment dispute prevention mechanism,but there are still some problems in this mechanism,such as the prominent administrative characteristics of investment dispute prevention institutions,the imperfect complaint mechanism of foreign-invested enterprises,and the provisions of the investment dispute prevention mechanism in bilateral investment agreements that need to be improved.Therefore,it is necessary to reform the operation mode of the investment dispute prevention mechanism,improve the complaint mechanism of foreign-invested enterprises and improve the content of bilateral investment agreements.
