论支付结算视角下帮助信息网络犯罪活动罪的二重性

摘　　要：帮助信息网络犯罪活动罪不仅具有技术支持、广告推广、涉“两卡”行为等促进上游信息网络犯罪既遂的第一重性,其以支付结算为代表的帮助行为还具有掩饰、隐瞒犯罪所得及其收益的第二重性,所以上游犯罪既遂后一定数额内的帮助掩饰、隐瞒犯罪所得及其收益的行为也应纳入本罪进行评价。故对二重性的清晰认识有助于我们准确把握本罪的犯罪内容并明确其与掩饰、隐瞒犯罪所得、犯罪所得收益罪的界限,即在罚当其罪时不应将本罪的支付结算行为拔高认定为掩饰、隐瞒犯罪所得、犯罪所得收益罪。在明确二重性的基础上,未来的司法实践应当准确把握支付结算的内涵,实现准确定罪量刑。The crime of helping information network criminal activities is not only supported technically, promoted by advertisements and involved in acts of“two cards”to promote accomplished predicate information network crime, which is its first quality,but its helping behaviors represented by payment settlement also has the second quality of disguising and concealing the proceeds and gains of crime. Therefore, this crime should, to a certain extent, absorb the act of helping to conceal the proceeds of crime after the accomplishment of the predicate crime. A clear understanding of the duality helps us to grasp the crime content of this crime and clarify the boundary between it and the crime of concealing the proceeds of crime, that is, the payment settlement behavior in this crime should not be elevated to the crime of concealing the proceeds of crime when the punishment is appropriate to its crime. On the basis of understanding duality, the future judicial practice should accurately grasp the connotation of payment settlement to achieve accurate conviction and sentence.
