摘　　要：大数据时代对个人信息的保护已经成为普遍关注的重点。作为个人信息保护的核心规则,知情同意在不同的法律法规当中早已明确,但是该规则的适用一直存在实施上的困难,用户个人信息的泄露并没有得到妥善解决。《个人信息保护法》的实施又再次强调知情同意是个人信息收集、使用的前提,同时,对个人一般信息和个人敏感信息的使用做了详细的区分。因此,从知情同意的视角,针对不同场景收集和使用的信息不同,应说明使用的目的和范围;区分不同信息下默示同意和明示同意的方式,在合目的范围内以最小限度使用用户的个人信息,这才符合个人信息收集必要性和正当性及诚实守信原则。The protection of personal information in the era of big data has become the focus of widespread concern.As the core rule of personal information protection,informed consent has long been clear in different laws and regulations,but the application of this rule has always been difficult to implement,and the leakage of users'personal information has not been properly solved.From the perspective of the existing mechanism,the formalization of notification and the choice of compulsory consent with all or nothing will affect the personal information rights and interests of users.The implementation of the Personal Information Protection Law emphasizes that informed consent is the prerequisite for the collection and use of personal information.At the same time,the use of personal general information and personal sensitive information made a detailed distinction.Therefore,from the perspective of informed consent,for different scenarios need to collect and use information,used to illustrate the purpose and scope,to distinguish the different information under implied consent and express consent,within the scope and purpose with minimal use of user's personal information,necessity and legitimacy is the personal information collection as well as honest and trustworthy.
