破产程序中建设工程价款优先受偿权的权利实现

摘　　要：建设工程价款优先受偿权制度的设立目的在于维护建设工程价款的特别优先权,而“无限制”状态的破产撤销权最易对建设工程价款优先受偿权的实现产生冲击,“不清晰”状态的消费者超级优先权也易影响建设工程价款优先受偿权的实现。强调建设工程价款优先受偿权为法定优先权能够缓解破产撤销权的冲击。同时,这一定性对建设工程价款优先受偿权行使程序的明确具有促进作用,并且有利于应对实践中出现的优先受偿权实现新情况。在破产程序中更好地实现建设工程价款优先受偿权,除对建设工程价款优先受偿权制度进行完善外,还需法律进一步明确购房人的超级优先权状态,并在破产撤销权行使要件中加入主观要件,审查主观是否善意。The establishment of the priority right to repayment of construction project price is to maintain the special priority of construction project price,and the“unrestricted”status of bankruptcy revocation right is most likely to have an impact on the realization of the priority to receive payment of construction project price,and the super-priority of consumers in the“unclear”state also easily affects the realization of the priority to receive the payment of the construction project price.Emphasizing that the priority of the right to repay the construction project price is the legal priority can alleviate the impact of the bankruptcy revocation right.At the same time,this certainty has a positive effect on the clarification of the procedures exercising the priority right of compensation for the construction project price,and is helpful to deal with the new situation of the realization of the priority compensation right in practice.In order to better realize the priority of payment of construction project price in bankruptcy proceedings,in addition to improving the system of priority of payment of construction project price,it is recommended that the law clarify the super-priority status of house buyers,and add subjective elements in the exercise of the bankruptcy revocation right to examine whether the subjective is in good faith.
