摘　　要：非同质化代币(NFT)是依托于区块链发行的数字资产,其创造性地连通了链上虚拟资产与链下实体资产。由于缺乏全面有效的监管制度,NFT在我国的应用过程中出现了价值认定不明、金融犯罪风险、网络信息安全、知识产权侵权等问题。在对NFT的国内监管现状进行分析后,文章提出数字经济时代NFT的本土规制路径:完善法律规制,设定NFT强保护体系;明确政府权责划分,采用监管沙盒计划;赋予平台审核义务,规定平台事后救济;实现用户自我监管,建立网络虚拟社区;积极参与国际交流,探寻国内治理方案。研究重点关注了NFT国内风险治理路径的构建,力求在监管和法治缺位的数字经济市场中探明NFT本土化合规化的路径,期待能为数字经济的发展提供一些理论参考。Non-fungible token(NFT)is the digital assets relying on blockchain issuance,creatively connecting on-chain virtual assets with off-chain physical assets.Due to the lack of a comprehensive and effective regulatory system,problems such as unclear value determination,financial crime risk,network information security,and intellectual property infringement have emerged in the application of NFT in China.Through the analysis of the current situation of domestic regulation of NFT,this study proposes the path of local regulation of NFT in the era of digital economy:improving the legal regulation and setting up a strong protection system for NFT;clarifying the division of power and responsibility of government and adopting a regulatory sandbox plan;giving the platform the obligation to audit and providing for post-event relief;realizing user self-regulation and establishing online virtual communities;actively participating in international exchanges and exploring domestic governance solutions.The study focuses on the construction of a domestic risk management path for NFT,and seeks to explore the path of localized compliance for NFT in the digital economy market where regulation and rule of law are lacked,so as to provide theoretical references for the development of the digital economy.
