摘 要:2017年起施行的《民法总则》正式构建起我国的意定监护制度,该制度的引入顺应了国内人口结构老龄化以及国际人权最新发展趋势的要求。为实现尊重本人意思自治和保障困难群体利益的平衡,各国在立法方面普遍加强了对意定监护主体的监督。近年来,国内学者对于我国意定监护监督制度的构建提出了诸多建议,但现行《民法典》在监护监督规范方面仍然近乎空白。伴随我国人口老龄化的快速发展和家庭结构的持续演变,可以预见,未来意定监护制度的利用者将进一步增多,为有效预防意定监护人滥用监护权的现象,应当参考域外立法例的相关经验,探索构建适合我国国情的意定监护监督模式。General Provisions of the Civil Law of the People's Republic of China,which came into force in 2017,formally structured the voluntary guardianship system of China,which was introduced in response to the requirements of the aging tendency of domestic population structure and the latest trends of international human rights development.Due to the special status of people under guardianship,countries around the world have established voluntary guardianship monitoring systems of their characteristics to achieve a balance between respecting the autonomy of the person and protecting the interests of the vulnerable.Although China’s scholars have made many suggestions for the construction of China's voluntary guardianship monitoring system,the Civil Code of the People's Republic of China,which came into effect on January 1,2021,is still crude and almost empty in terms of guardianship monitoring regulation.In the context of the rapid acceleration in the growth of the elderly population and changes in family structure in China,the number of users of the voluntary guardianship system will constantly grow in the future.For preventing guardianship abuse by voluntary guardians effectively,it is essential to refer to overseas legislation to explore the construction of a voluntary guardianship monitoring model consistent with China's national conditions.
