民族地区法院调解社会化的本土资源及其推进路径

摘　　要：民族地区法院调解社会化既是历史上少数民族社会纠纷解决方式的延续,又有少数民族传统调解资源的有力支撑。当前,在构建“大调解”格局的时代背景下,民族地区各级法院应当顺应法院调解社会化趋势,依托“协助调解”与“委托调解”制度,明确法院调解社会化的结构定位,加快特邀调解组织和特邀调解员队伍建设,完善委托调解的监督管理与激励机制,并构建和完善少数民族习惯审查、指令回避等相关配套机制。In ethnic regions,the socialization of court mediation is not only the continuation of the historical experience of solving social disputes of ethnic minorities,but also the support of traditional mediation resources of ethnic minorities.At present,against the background of constructing the pattern of “grand mediation”,courts at all levels in regions of ethnic minorities should comply with the trend of socialization of court mediation,rely on the system of “assisted mediation” and “entrusted mediation”,clarify the structural orientation of the socialization of court mediation,accelerate the construction of specially invited mediation organizations and teams of specially invited mediators,improve the supervision,management and incentive mechanism of specially invited mediation,improve the incentive mechanism for social forces to participate in mediation,and build and improve relevant supporting mechanism such as the habit review of ethnic minorities,the mediator’s withdrawal system and so on.
