摘　　要：“法学”是指以法律现象为研究对象,以追求秩序与正义为目的的科学。此种全面的法学概念,才能将中国古代法学容纳其中。法学并不只是理论体系,它还需包含运作实体。这包括法学家群体,法学研究成果和法学教育机构等物质载体。中国古代法学家群体多为官僚阶层;法学研究成果颇丰;法学教育起源较早、发展稳定、样态独特。中国古代法学的研究内容包括法律本体、法律事实、及法律价值三大板块。其法律本体的研究以成文法为主,判例法为辅;其重视对法与社会的关系及法律的运用等事实问题的研究;亦偏重于对“秩序”与“和谐”的价值研究。在发展历史上,中国古代法学萌芽于春秋战国,形成于秦,在唐宋时期达至顶峰,于明清时期衰落。中国古代法学的存在已是不争的事实,如何传承及借鉴中国古代法学,发掘中国古代法学的现代价值,才是问题的关键。"Jurisprudence"refers to the science which takes legal phenomenon as its research object and aims at pursuing order and justice.This comprehensive concept of jurisprudence can accommodate the ancient Chinese jurisprudence.Jurisprudence is not only a theoretical system,but also a combination of operational entities including material carriers such as jurists,legal research achievements and legal education institutions.Most of the jurists in ancient China were bureaucrats;there were many achievements in legal research;legal education originated in early time and it developed stably with unique forms later on.The research content of ancient Chinese Jurisprudence includes legal noumenon,legal facts and legal value.The research of its legal noumenon is mainly written law,supplemented by case law,focusing on the relationship between law and society,the application of law and other factual issues,and the value of"order"and"harmony".In the history,ancient Chinese jurisprudence originated in the Spring and Autumn Period and Warring States Period,formed in the Qin Dynasty,reached its peak in the Tang and Song Dynasties,and declined in the Ming and Qing Dynasties.It is an indisputable fact that ancient Chinese jurisprudence ever existed.How to inherit and learn from ancient Chinese jurisprudence and explore its modern value is crucial in this regard.
