摘　　要：为平衡个人信息的保护与利用,促进数字经济的有序发展,《个人信息保护法》第13条确立的个人信息合理使用制度应被解释为可适用于敏感个人信息。有关敏感个人信息处理需要获得“单独同意”“监护人同意”的特殊规则,系针对处理个人信息需取得信息主体同意之一般规定的特别规定,并非排斥、否认《个人信息保护法》第13条第1款第2—7项所列个人信息合理使用情形在敏感个人信息处理领域的适用。在依据第13条合理使用敏感个人信息时,一方面应受《个人信息保护法》第28条“特定的目的”和“充分的必要性”之规定的“双重约束”;另一方面应始终围绕保护信息主体人格权益对合理使用情形加以严格解释,防止宽泛适用导致合理使用制度的滥用。In order to balance the protection and use of personal information and promote the orderly development of digital economy,the reasonable use system of personal information established in Article 13 of The Personal Information Protection Law should be interpreted as applicable to sensitive personal information.The special rule that "individual consent" and "the guardian’ s consent" are required for the processing of sensitive personal information is the special provision for the general provision that the processing of personal information requires the consent of the information subject,which does not exclude or deny the application of the situations for reasonab le use of personal information listed in Article 13 Paragraph 1 Items2 to 7 of The Personal Information Protection Law to sensitive personal information processing.Using sensitive personal information reasonably in accordance with Article 13,on the one hand,should be subject to the "double constraints" of "specific purpose" and "sufficient necessity" in Article 28;on the other hand,the situations for reasonable use should always be strictly explained on the protection of the personal rights and interests of the information subject,so as to prevent the abuse of the reasonable use system caused by broad application.
