侵害知识产权惩罚性赔偿数额的解释困境及其抉择

摘　　要：近年来司法实践和理论界对知识产权惩罚性赔偿“在赔偿基数的‘一倍以上五倍以下’确定赔偿数额”这一规定的理解出现了分歧。不同于此前法院普遍适用的直接以赔偿基数乘以倍数作为最终赔偿额的计算方式,新出现的一种解释方法认为应在“一倍以上五倍以下”赔偿数额之外再加上作为赔偿基数的填平性赔偿作为总赔偿额,目的是填补“一倍以上”取本数一倍时的赔偿数额不具有惩罚性的法律漏洞。然而这种解释排除了在赔偿基数的“一倍”到“二倍”之间确定惩罚性赔偿数额的可能性,也会导致惩罚性赔偿的最高数额为赔偿基数的六倍而背离立法本意。为解决两种解释方法下各自存在的问题,本文建议删去“一倍以上”这一表述或对“一倍以上”作出“不包含本数一倍”的特别解释,统一我国法院适用知识产权惩罚性赔偿数额的裁判标准。In recent years,the judicial practice and the theoretical circle of intellectual property punitive damages"in the compensation base of'more than one times and less than five times'to determine the amount of the understanding of this regulation appears differences.Different from the calculation of the final compensation amount which is directly based on the compensation base multiplied by multiple,which is generally applied by the court before,a newly emerged interpretation method thinks that the total compensation amount should be added with the filling compensation as the compensation base in addition to the compensation amount of"one times and less than five times".The purpose is to close the legal loophole that"more than one time"when the amount of compensation is not punitive.However,this interpretation excludes the possibility of determining the amount of punitive damages between"one time"and"two times"of the compensation base,and also leads to the maximum amount of punitive damages being six times of the compensation base,which deviates from the original intention of the legislation.In order to solve the problems under the two interpretation methods,this paper suggests deleting the expression of"more than one time"or making a special interpretation of"more than one time"that"does not contain one time"and unifying the adjudication standard of the amount of intellectual property punitive damages applied in Chinese courts.
