摘  要:专利审查过程中对于创造性的评价,可以通过“三步法”,即,步骤(1)确定最接近的现有技术;步骤(2)确定发明的区别特征和发明实际解决的技术问题;步骤(3)判断要求保护的发明对本领域技术人员来说是否显而易见。其中,步骤(1)确定最接近的现有技术是发明的创造性评价起点。步骤(3)是判断现有技术是否给出区别特征实际解决技术问题的技术启示,从而判断步骤(2)区别特征实际解决的技术问题对本领域技术人员是否显而易见。因此,对现有技术公开的事实认定对确定发明区别特征和发明实际解决的技术问题以及是否有技术启示至关重要。结合案例,从专利审查的视角讨论在创造性答复中事实认定的重要性,为农药领域的申请人在答复审查意见通知书时提供参考和借鉴。In the process of patent examination,the evaluation of inventiveness is carried out through a"three-step method",that is,step(1)to determine the closest prior art;step(2)to determine the distinguishing features of the invention and the technical problem actually solved by the invention;and step(3)to judge whether or not the claimed invention is obvious to a person skilled in the art.Wherein,the closest prior art determined in the step(1)is the starting point of the creativity evaluation of the invention.Step(3)is to judge whether the prior art provides the technical enlightenment for the distinguishing technical feature to actually solve the technical problem,so as to judge whether the technical problem actually solved by the distinguishing feature in step(2)is obvious to those skilled in the art.Therefore,the fact determination of the disclosure of the prior art is crucial to determine the distinguishing features of the invention,the technical problems actually solved by the invention and whether there is technical enlightenment.This paper discusses the importance of fact finding in the creative reply from the perspective of patent examination,and provides reference for applicants in the field of pesticides when replying to the notice of review opinions.
