道路条件变化导致运输降效费用索赔计算方法的研究

摘　　要：水电工程经常出现因各种原因导致项目实施阶段和发包人招标阶段给出的道路条件不符,造成合同边界条件变化,给承包人造成损失,承包人提出索赔,但又因导致合同边界条件发生变化的原因较多,施工过程的证明文件较多且复杂,承包人往往举证困难,补偿费用难以计算。目前,水电工程道路条件变化导致的运输降效可参照的案例较少,对道路条件变化导致运输降效费用补偿的合同原则、计算依据、实际情况及计算方案结合案例进行了分析探讨,提出了水电工程道路条件变化导致运输降效费用索赔的计算方法。Hydropower projects often have road conditions different from those given in the bidding stage of the contractor due to various reasons.It results in changes in contract boundary conditions and losses to contractors.When the contractor makes a claim,there are many reasons that cause the boundary conditions of the contract to change.There are many and complex documents to prove the construction process.It is often difficult for the contractor to provide proof and the compensation cost is difficult to calculate.At present,there are fewer cases of transportation inefficiency due to changes in road conditions of hydropower projects.In this paper,the contractual principle,calculation basis,actual situation and calculation scheme of compensation for transportation efficiency reduction caused by road condition changes are analyzed and discussed,and the calculation method of compensation for transportation efficiency reduction caused by road condition changes of hydropower projects is proposed.
