企业数据产权化的理论逻辑与实践架构

摘　　要：数据作为人类的共有资源,是人类在信息化时代实现自我生存必不可少的需求要素,且企业生产数据的过程符合洛克的劳动范式,故企业对数据的支配具有正当性。企业数据产权化契合洛克财产权证立的资源充足留存要件,故企业对数据的排他性占有具有正当性。多重利益复杂交织和法律属性多维衍变的特性构成了企业数据产权化的实践障碍,产权理论框架是突破这些障碍的重要范式。在产权理论框架下,原始数据/数据产品应采用绝对排他性私有产权,赋予数据控制者/数据源加工处理者占有、使用、收益和处分(处置)数据的权利。数据集合应采用有限排他性私有产权,赋予数据源加工处理者使用、转让、分配数据集合,以及对抗他人不当获取和利用数据集合行为的权利。As a common resource of human beings,data is an essential demand element for human beings to pursue self-survival in the information age.The domination of data by enterprises is legitimate in that the process of enterprises producing data conforms to Locke’s labor paradigm.The property rights of enterprise data are in line with the requirements for sufficient resources to be retained for the establishment of property rights in Locke’s theory,so enterprises’exclusive possession of data by is justified.The complex interweaving of multiple interests and the multi-dimensional evolution of legal attributes constitute practical obstacles to the property rights of corporate data.The theoretical framework of property rights is an important paradigm to break through these obstacles.Under the framework of property rights theory,raw data/data products should adopt absolutely exclusive private property rights,giving data controllers/data source processors the power to possess,use,benefit from and dispose of data.Data collections should adopt limited and exclusive private property rights,granting data source processors the right to use,transfer,and distribute data collections,as well as resist the improper acquisition and use of data collections by certain perpetrators.
