黄河流域生态环境犯罪集中管辖问题研究——以协同治理为视角

摘　　要：黄河流域生态环境保护和高质量发展进程中,生态环境犯罪尤其是污染环境犯罪已经成为破坏生态环境最主要的形式,案件办理的专业性、治理的复杂性要求司法部门的专门化,集中管辖则是其中具体的体现。在研究国内各地尤其是黄河流域各省区对于生态环境案件集中管辖制度安排的基础上,剖析司法实践中集中管辖与诉讼两便原则存在冲突、刑事案件集中管辖法律依据缺位、案件集中管辖制度设计不尽完善、集中管辖案件数量与预期存在差异等问题,提出明确黄河流域生态环境刑事集中管辖法律依据、探索黄河流域生态环境案件跨省集中管辖体制、完善黄河流域生态环境案件集中管辖制度设计、健全黄河流域生态环境案件集中管辖衔接机制等建议。In the process of ecological environmental protection and high-quality development in the Yellow River Basin, ecological and environmental crimes, especially pollution crimes, have become the most important form of ecological environment damage. The professionalism of the case processing, the complexity of governance requires the specialization of the judicial sector, which is manifested through centralized jurisdiction. Based on the study of the arrangement of centralized jurisdiction system for ecological and environmental cases in various parts of China, especially in the provinces and regions of the Yellow River Basin, the paper analyzes the conflicts between trial and litigation values in the implementation of the centralized jurisdiction system, the difference between the expected and actual effects of the system design, the lack of legal basis for centralized jurisdiction of criminal cases, and the limitation of the vision of the centralized jurisdiction system. Therefore, the paper proposes to strengthen the legitimacy of the basis of criminal jurisdiction, explore cross-provincial centralized jurisdictional system, and improve the centralized jurisdiction system design, improve the design of the centralized jurisdiction system, and improve the centralized jurisdiction judicial interface and other recommendations.
