摘　　要：行政裁决主要解决与行政管理密切相关、但与合同无关的民事纠纷。行政裁决作为多元纠纷解决机制中重要的非诉解纷途径,其作为化解民事纠纷分流阀的应有制度功能尚未得到真正发挥,在性质、功能和定位上应当进一步明确。目前,亟需完善的行政裁决制度尚存在法律体系分散化、适用范围不明确、裁决程序不明晰、与行政调解、行政复议和诉讼解纷机制衔接不畅通等问题。在全面依法治国、建设法治政府和社会治理体系法治化与现代化背景下,通过明析行政裁决在多元纠纷解决机制中的性质、定位与功能,从立法规范、组织保障、程序优化和解纷机制互相衔接等多方面完善行政裁决制度,使得多元纠纷解决机制运转更为畅通。Administrative adjudication mainly resolves civil disputes that are closely related to administrative management but not related to contracts.As an important non-litigation dispute resolution method in the multi-dispute resolution mechanism, administrative adjudication has not really played its due institutional function as a diversion valve for resolving civil disputes, and should be further clarified in nature, function, and orientation.At present, the administrative adjudication system in urgent need of improvement still has problems such as the decentralization of the legal system, the unclear scope of application, the unclear adjudication procedures, and the lack of smooth connection with the administrative mediation, administrative reconsideration, and litigation dispute resolution mechanisms.Under the background of comprehensive rule of law, the establishment of a rule-based government and the legalization and modernization of the social governance system, through the clear analysis of the nature, positioning and function of administrative adjudication in the multi-dispute resolution mechanism, the administrative adjudication system should be improved in many aspects such as legislative norms, organizational guarantees, and the connection of procedural optimization and dispute resolution mechanisms, so as to makesmoother the operation of the multi-dispute resolution mechanism.
