袭警罪案件专题分析及规范化研究——以556篇袭警罪裁判文书为分析样本

摘　　要：目前,袭警行为并不罕见,但以袭警罪定罪的案件所占比例较低,其原因主要是袭警罪适用中定罪量刑的标准不统一,认定被告人从轻处罚情节宽泛,对被害人权益保护不充分。在司法实践中,应制定司法解释或发布指导意见,统一司法认定标准;规范量刑规则,审慎适用从轻处罚制度;增强公共服务意识,提升执法规范化能力;维护警察合法权益,增强警察个人防护能力;加强舆论正面引导,构建和谐警民关系,以维护正常执法秩序和法律权威。The analysis of 556 judgments shows that the crime of assault on police doesn’t remain uncommon,the standards of conviction and sentencing are not uniform,the circumstances of lenient punishment for the defendant are broad,and the protection of the rights and interests of victims is not sufficient.In judicial practice,the following measures should be taken to reduce the occurrence of such cases:Formulate of judicial interpretation or the release of guidance,unified judicial identification standards;Standardize sentencing rules and prudently apply the system of lenient punishment;Enhance the public security organs public service awareness,enhance the ability of law enforcement standardization;Safeguarding the legitimate rights and interests of police and enhancing their personal protection capabilities;Strengthen the positive guidance of public opinion,harmonious police relations.
