摘 要:“四种形态”是党的十八大之后形成的新型执纪执法要求,已成为实践工作中监督执纪和监察执法的基本遵循。中国式反腐是政党主导的政党反腐和国家反腐的二元合一体系,存在纪律治理和法律治理两个维度,建党建政的历史和现实决定治腐必先治党。“四种形态”的内核源自中国共产党传统腐败治理思想,生成于对腐败治理现实问题的回应,但在监察体制改革后出现适用范围扩展、指标化倾向以及形态之间的转换风险,应通过采取建立案例指导制度和形态适用标准规范等措施来予以完善与控制。The“Four Forms”of discipline enforcement are a new theoretical system formed after the Eighteenth National Congress of the CPC and have become the basic guiding rules in discipline inspection and law enforcement.China’s anti-corruption is a dual system of Party-leading anti-corruption and national anti-corruption,which has two dimensions of disciplinary governance and legal governance,the history and reality of Party building and government building determining that it is necessary to govern the Party before rectifying corruption.The core of“Four Forms”inherits the traditional corruption governance thought of the Communist Party of China and is generated in the response to the practical problems of corruption governance.After the supervision reform,the“Four Forms”tend to be expanded in their application scopes,indexation and variation between themselves which is to be curbed by means of guiding cases and application standards for each of them.
