摘　　要：《民法典》第511条属于填补合同漏洞的条款,其第1项确立了质量条款欠缺时优先援引标准作为合同履行依据的规则。这一规则是对标准化成果的利用,反映了在标准化事业发达的背景下合同与标准之间的密切联系。适用这一规则,不仅强制性国家标准、推荐性国家标准和行业标准可以被援引作为合同履行的依据,地方标准、团体标准和企业标准乃至国际标准、外国标准亦可作为“通常标准”或“特定标准”而被援引为合同履行的依据。Article 511 of the Civil Code can fill the lacunae in contracts.The Section 1 of this article estab⁃lishes a rule that a standard shall be invoked first as rules for the performance of a contract in case of no quality clause.This rule indicates development of the results of standardization,reflecting the close relationship be⁃tween contract and standard in the context of advanced standardization.This rule can be used not only in man⁃datory national standard,voluntary national standard and voluntary industry standard,but also in local stan⁃dards,group standards,enterprise standards,international standards and foreign standards.
