摘　　要：我国是一个土地资源极为丰富的国家,总的来说,我国土地具有农业用地占比大、人均占有数量少,林业适用地较多,农业适用地较少,土地资源的后备储蓄量不足、分布较为杂乱,各地区的土地生产力差异显著的特点。随着我国经济的快速增长,土地问题也日益增加,出现了很多非法转让土地的行为。2020年1月1日,新修订的《土地管理法》正式实行,部分土地问题得到改善,但是我国对于非法转让土地法律责任的相关规定仍不够明确,且处罚决定在实际中也难以落实、难以执行,这不仅对我国的土地管理制度造成了严重损害,并且还阻碍了我国社会主义市场经济的有序发展。本文将在梳理非法转让土地的责任及其形式的一般原理基础上,提出在立法和实践中存在的问题,并提出明确相关法条、立法和司法时注意与其他法律的结合、落实共同责任机制、实践上注意与《城乡规划法》的衔接等完善建议。China is a country with extremely rich land resources.In general,China's land has the characteristics of large proportion of agricultural land,less per capita occupation,more suitable land for forestry and less suitable land for agriculture,insufficient reserve reserve of land resources,relatively chaotic distribution,and significant differences in land productivity among different regions.With the rapid growth of China's economy,land problems are increasing,and there are many illegal land transfers.On January 1,2020,the newly revised"land management law"formally implemented,some land problem improved,but the illegal transfer of land for the related provisions on legal responsibility is still unclear,and the penalty decision in practice are also difficult to implement and difficult to enforce,this not only to our country land management system caused serious damage,And also hindered the orderly development of China's socialist market economy.This article in combing the responsibility of illegal transfer of land and in the form of a general principle,points out problems existing in the legislation and practice,and put forward specific laws,legislative and judicial notice and other laws,implementation of the joint liability mechanism,the combination of practice,pay attention to and the cohesion of the urban and rural planning act such as perfecting suggestion.
