摘　　要：银行账户担保是用在银行开立的一般或特定账户做担保,是一种特殊的用对银行的付款请求权所做的担保,一种基于特殊担保财产的担保。设立银行账户担保仅由设立协议即可。使担保权对第三人发生效力,可通过对银行账户实际控制方式来实现。账户特定担保资金与其他担保资金或其他非用于担保的资金发生混合时,先按照资金的可识别性加以区分甄别;不能直接识别时,按最低期间余额原则或比例份额原则推定确定。Security in bank accounts is a general or specific account opened with a bank as a guarantee,and it is a special guarantee with the right to payment from the bank,a kind of special-collateral-based security.The creation of Security in bank accounts is only required by the creation of agreement.Making the security right effective against third parties can be achieved by means of actual control over the bank account.When the specific guarantee funds in bank accounts are mixed with other guarantee funds or other funds not used for guarantee,they shall be distinguished and screened according to the identifiability of the funds;if they cannot be identified directly,they may shall be determined according to the presumed lowest intermediate balance rule or the proportionate sharing rule.
