摘　　要：学界关于中医师处方权的权利行使边界争议不少,论争点主要为中医师是否享有开具西药的权力及其界限。本文分析“中医师处方权”的内涵及其法律性质,结合我国基本医疗服务的特点提出完善我国中医师处方权法律规制的建议,即重新设计符合国情的医师执业类别,重构中医处方权的权利主体,合理界定中医师处方权的权利行使范围。There are a lot of disputes in the academic circle about the exercise boundary of TCM physicians'prescribing right,and the main point of contention is whether TCM physicians have the right to prescribe western medicine and its boundary.This paper analyzes the connotation and legal attributes of"TCM physicians'prescribing right",and puts forward some suggestions to improve the legal regulation of TCM physicians'prescribing right in com⁃bination with the characteristics of basic medical services in China,i.e,redesigning the practice category of physi⁃cians in line with the national conditions,reconstructing the right subject of TCM prescribing right,and reasonably defining the exercise scope of TCM physicians'prescribing right.
