摘　　要：自2018年以来我国陆续制定并颁布了系列卫生法律法规,初步建立了医疗纠纷预防与处理机制;虽然这些新法的实施并未废止诞生于二十年前的《医疗事故处理条例》,但两者之间确然存在着法条竞合、内容冲突、责任混同、监管缺位等不协调的问题,严重影响了法律规范的准确性,故修订《医疗事故处理条例》成为当务之急,特别是其关于“医疗事故”概念、预防处置与赔偿规则以及罚则等的内容和章节。Since 2018,China has successively formulated and promulgated a series of health laws and regula⁃tions,and initially established a mechanism for the prevention and handling of medical disputes.Although the imple⁃mentation of these new laws has not abolished the Regulations on the Handling of Medical Malpractice,which was en⁃acted 20 years ago,there are still some uncoordinated problems between the two,such as the concurrencation of laws and regulations,content conflicts,confused responsibilities and lack of supervision,which seriously affect the accura⁃cy of legal norms.Therefore,it is urgent to amend the Regulations on the Handling of Medical Malpractice,especially its contents and chapters on the concept of"medical malpractice",rules on preventive treatment and compensation,and penalties.
